Apply for the extension at the police station before your stay ends. It can never take you past ninety days in a hundred and eighty.

A Schengen visa can be extended if something prevents you from leaving in time — a cancelled flight, an accident, an illness — or if there are serious personal reasons (Art. 33 of the EU Visa Code). In Spain the application is filed at the police station of the province where you are, and it is granted by the Comisaría General de Extranjería y Fronteras, the national police's immigration and borders headquarters (Art. 32 of the Immigration Regulation, Real Decreto 1155/2024). Those who do not need a visa, such as Argentines or Americans, have their own extension in Article 49, with more paperwork and a cap of three more months. Without an extension, on day ninety-one the stay becomes irregular.

The Visa Code distinguishes two extensions. The one for force majeure or humanitarian reasons must be granted, and is free; the one for serious personal reasons may be granted, and there is a fee.

Two different extensions

If the holder shows humanitarian reasons or force majeure preventing them from leaving before the visa expires, it 'shall be extended', free of charge (Art. 33.1). If they invoke serious personal reasons, it 'may be extended', for a fee of €30 (Art. 33.2). The decision belongs to the State where the traveller is when applying; it takes the form of a new visa sticker and keeps the territorial validity of the original visa (Arts. 33.3, 33.4 and 33.6). The Foreign Ministry's official publication gives examples from the EU handbook: the person being visited falling ill again, or negotiations that last longer than planned.

In Spain, the police station

The application is filed at the police station of the province where you intend to stay, and granted by the head of the Comisaría General de Extranjería y Fronteras. The total stay, including the extension, cannot exceed ninety days in a hundred and eighty. The police website asks for the form, a passport valid beyond the extension, proof of the reasons, financial means, travel insurance, a return ticket, and the fee on form 790, code 012, which in September 2026 shows €32.17 for an extension with a visa, without distinguishing the reason.

Without a visa: exceptional reasons and three more months

Someone who entered without a visa may apply for up to three additional months in the circumstances of Article 20 of the Schengen Convention. They must show exceptional reasons, means, insurance with the cover required for a short-stay visa, and guarantees of return, and must identify themselves in person at the police headquarters or station. If there is no answer in time, the application is deemed refused. A refusal orders departure before the initial stay ends or, if it has already ended, within seventy-two hours at most. An extension granted covers relatives on the same passport who are in Spain.

If you overstay

Being in Spain without having obtained the extension is a serious offence. It is punished with a fine of €501 to €10,000 or, where there are grounds for it, with expulsion — never both. Expulsion carries an entry ban of up to five years, and up to ten if there is a serious threat. However, under the Act no ban is imposed on someone who leaves Spain while proceedings for irregular stay are under way, and a ban is revoked if they leave within the voluntary departure period set in the order, in the cases the Regulation determines (Art. 58.2).

What the courts say

Three extensions that ended up in court

Only if you prove it and bring the other papers. In STSJ CV 6238/2024 of 3 December (appeal 142/2024, Section Five), a judgment of the High Court of the Valencian Community, an Algerian man who entered the Schengen area on 10 January 2023 applied on 10 February, the last day of his stay, for an extension to look after a fellow Algerian with a 100 % motor disability. The provincial police chief in Castellón refused it six days later. The court upheld the refusal: there was no report proving that disability or the need for a carer, only an emergency discharge note for multiple sclerosis diagnosed more than ten years earlier and an ophthalmology report; and financial means, insurance, a guarantee of return and even the length of the extension sought were missing. Costs against the applicant, up to €800.

No. The extension must be applied for while the stay is still running (Art. 49.1: whoever 'is in Spain in a situation of stay'). In STSJ CV 3587/2024 of 2 July (appeal 19/2024, Section Five), a Colombian woman with a study stay until 16 December 2022 applied on 3 January 2023 for an extension of stay under Article 30.2 of the Immigration Act; it was refused on 27 January, and on 8 February she filed a new study application, which was declared inadmissible. The court explained that once her stay had ended without an extension she was in an irregular situation and could no longer apply from there. Even if the January request were accepted on 'a very lax interpretation', its refusal left her in an irregular situation again. Costs against the applicant, up to €800. It is a student's case, but the timing rule is the same.

Not necessarily. In STS 1021/2024 (judgment 287/2024) of 22 February (cassation appeal 6629/2022), the Supreme Court held that irregular stay is punished, as a rule, with a fine, together with an order to leave voluntarily, and that expulsion requires aggravating circumstances assessed case by case and set out in the decision itself: the judge cannot add others later. In that case, a Honduran man stopped by the police in Madrid on 2 January 2020, with no papers proving his stay and no identity documents, was expelled with a five-year entry ban. Being undocumented is an aggravating factor, and the Supreme Court upheld the expulsion; each side paid its own costs. Someone who still has their passport with the entry stamp and a known address is in a different position.
